Terms and Conditions

These terms apply when you use www.derbymrt.org.uk and when you buy, donate, give regularly, enter an event or run a fundraising page through it. Please read them before you order. Nothing in them affects your legal rights as a consumer.

About us

The website is run by Derby Mountain Rescue Team ("Derby MRT", "we", "us"). We are a registered charity (No. 1089237) and a company limited by guarantee registered in England and Wales (No. 4229996). Our registered office is Ashbourne Road, Mackworth, Derby, DE22 4NB.

1. Using the website

• We try to keep the site available and accurate, but we can't guarantee it will always be available or free of errors. We may change or withdraw any part of it.
• Please don't misuse the site. That includes:
  • breaking the law
  • trying to get into parts of the site you aren't allowed in
  • uploading malicious code
  • interfering with how the site works
  • using it to send spam
• The text, photos, logos and other content belong to Derby MRT or to the people who licensed them to us. You're welcome to view, print and share pages for personal use, and to link to any page. Please don't copy our content or logo for commercial use, or suggest we endorse something, without asking us first.
• Links to other websites are for convenience. We aren't responsible for their content.

2. Ordering from our shop

Your order and our contract

When you place an order, we email you to confirm it. That email means we've accepted your order, and the contract between us starts then.

If we can't supply something, for example because it has sold out or the price shown was clearly wrong, we'll tell you as soon as possible and refund anything you've paid for it.

Prices and payment

• Prices are in pounds sterling. Delivery charges are shown at checkout before you pay.
• Payment is taken when you place your order.
• Card payments, Apple Pay and Google Pay are processed securely by Stripe. We never see or store your full card details.

Delivery

• Clothing is made to order for you. Each product page says when it will normally be made and posted. We'll email you when your order is on its way.
• Delivery times are estimates. If something outside our control delays your order, we'll keep you informed.
• Some items, such as greeting cards and car stickers, are sent from stock.

Changing your mind

You can cancel any physical item within 14 days of receiving it, without giving a reason:

1. Email [email protected] within the 14 days to say you're cancelling.
2. Return the item, unused and in its original condition, within 14 days of telling us. You pay the cost of returning it.
3. We'll refund the price and the original standard delivery charge within 14 days of getting the item back.

Faulty or damaged items

If something arrives damaged, faulty or not as described, email [email protected] with a photo. We'll replace it or refund you, including any return postage. This is in addition to your rights under the Consumer Rights Act 2015.

3. Donations

• Donations go to Derby Mountain Rescue Team's work.
• Card processing fees are deducted from each payment before it reaches us. These are Stripe's charges plus the website platform's charge.
• Wishlist items are virtual gifts. When you "buy" an item from a wishlist, you donate its cost. Nothing is sent to you. We spend the money on that item or, if we no longer need it, on similar equipment.
• Appeals, such as the new base appeal, fund the purpose described on the appeal.
• If you donated by mistake, email us within 14 days and we'll refund you. After that, donations aren't normally refundable, but please ask us.
• Donation wall. When you donate, you choose whether your name, the amount and a message are shown on the site. Messages must be suitable for a public page. We may edit or remove any message.

Gift Aid

Gift Aid lets us claim 25p from HMRC for every £1 you give, at no cost to you.

• To add Gift Aid, you must be a UK taxpayer.
• If you pay less Income Tax and/or Capital Gains Tax in a tax year than the Gift Aid claimed on all your donations, it is your responsibility to pay the difference.
• Your declaration covers that donation, future donations and those made in the past four years.
• Please tell us if you want to cancel it, or if you change your name or home address, or no longer pay enough tax.
• Gift Aid can't be claimed on payments that buy something, such as clothing or event entries.

4. Regular giving (Friends and Supporters)

• A regular donation is taken from your card monthly, or on the schedule you chose, until you stop it.
• You can pause, change the amount or cancel at any time from My Account, or by emailing us. If you cancel, no more payments are taken. Your Friend or Supporter benefits last until the end of the period you've paid for.
• If a payment fails, we'll email you and try again. If it keeps failing, your regular gift will stop.
• If we ever change how regular giving works, we'll tell you first.

5. Event entries

• An event entry, such as the Matlock Skyline Challenge, is for the event and date shown. Each event's page and FAQs form part of your entry, including any rules about refunds, transfers and minimum age.
• If we cancel an event, we'll offer you a refund or a place on the rescheduled date.
• You take part at your own risk and must follow the event rules and the marshals' instructions. Nothing in these terms limits our liability where the law doesn't allow it (see section 7).

6. Fundraising pages

You can set up a page to raise money for us. By creating one, you agree that:

• We check every page and photo before it goes live. We may decline, edit, pause or remove a page or photo, for example if it is inaccurate, offensive or misleading, or uses material you don't have the rights to.
• Your page, your name and the photos you upload are public.
• You'll describe your fundraising honestly, keep to the law and stay safe. If you organise an activity or event, it's your responsibility.
• Donations made on your page are paid straight to Derby MRT. They are donations to the charity, covered by section 3, and you never handle the money.
• You give us permission to show your page and photos on our site, and to share them to promote your fundraising.

7. Our responsibility to you

• If we break these terms, we're responsible for loss or damage you suffer that is a foreseeable result of that, but not for loss that wasn't foreseeable.
• We supply goods for personal use only. We aren't responsible for business losses.
• Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow us to limit. This includes your rights under the Consumer Rights Act 2015.

8. Complaints

If you're unhappy with anything, please email [email protected] and we'll try to put it right quickly.

9. General

• We may update these terms. The version on this page when you place an order or donate is the one that applies to it.
• If a court finds part of these terms unenforceable, the rest still applies.
• If we don't enforce a term straight away, we can still enforce it later.
• These terms are governed by the law of England and Wales. You can bring claims in the courts of England and Wales or, if you live in Scotland or Northern Ireland, in your local courts.
